Jaque Fourie does not have a standard players contract with the Golden Lions Rugby Union (GLRU) and that is just one of the reasons he believes his agreement with the union is not binding. He is also believed to be tired of having to play above himself to carry the Lions along with a handful of team-mates, and is said to be tired of the losing culture of the union. Fourie wants to leave the Lions to join Western Province, so that he can play for the Stormers next year.

Arbitration in the dispute between Fourie and the GLRU ended in Johannesburg on Tuesday, but a finding is only expected early next week. Information at Sport24’s disposal suggests that Fourie has a strong case.

The collective agreement between the South African Rugby Players’ Association (Sarpa) and the South African Rugby Employers Organisation (Sareo) determines that rugby unions must enter into agreements with players on standard players contracts.

Sports24 revealed the following:

-Fourie does not have a standard players contract with the union. He did, however, enter into an agreement with them on August 11, 2008.

– Sareo already on June 26, 2008 sent the standard players contract and new collective agreement to rugby unions, and there was no reason for the GLRU to not apply it to Fourie.

– The agreement that Fourie reached with the GLRU does not stipulate his remuneration for the second year of the so-called contract. Furthermore, the terms of his remuneration such as allowances, deductions, match fees and bonuses have not been filled in.

 – Fourie’s contract with the GLRU indicates that he has been appointed as a “professional analyst” and not a rugby player.

The Springbok centre believes his relationship with the GLRU has broken down because he was prevented from joining French club Clermont earlier this year and his salary for next season was not revised.

Fourie apparently followed grievance procedures, but talks with Lions chief executive Manie Reyneke and union consultant Jake White did not solve the problems.

He is tired of the losing culture at the union, which is preventing him from reaching his professional, personal and financial goals.

Sarpa chief executive Piet Heymans called on rugby unions and player agents to use the standard players contract.

“All the parties have to do on the standard players contract is to fill in the remuneration and the term. The rest is determined by a broad process of negotiations between Sarpa and Sareo. The provinces should take cognisance of the collective agreement, of which the standard contract is an attachment,” said Heymans.

 Sport24 has learned that six Lions players do not have standard contracts. Willem Alberts and Louis Ludik are also among them. Both have offers from the Sharks.

    Okay so the only quoted reason the Lions are fighting tooth and nail for Mossie is because:

    “We would release him to an overseas club but out of principle we will not release him to a South African union as he would be playing against us”

    Am I the only one that finds this reasoning warped?

    It does seem though that everytime there is bad buying of players WP is involved….

    In jaques case sure if he wanted winning culture he should have gone to Sharks or Bulls?.

    I feel the wanting the Cape is more about the snob Cape life style and i think his wife is beind that.

    Hahahahaha, now AC start to read our minds, he is trying his utmost to restore Blaauws ego trip.

    But Coetzee believes it is an indication that the Bulls, who were dominated at scrum time by WP in their last meeting at Newlands a couple of weeks ago, fear Blaauw and WP’s ability to exert pressure in this phase.

    @Mr-T – its the lions own fault…they forgot to dot the i’s and cross the t’s. there are a number of players who have been made good offers from the sharks who sit with the same problem….watch…if fourie gets it right they will follow in his footsteps. and lets face it…the lions have been battling for a number of years. wp have still been doing better overall in super competition over the last few years. i am looking forward to seeing him in the blue and white stripe just like habana.

    Its a pity he wants to leave. JF is a great player but I suppose you just wont get the best out of a player if he does not want to play for that union. Then just let him go.

    Lions I think are doing well without him right now. JF never played in the game last Saturday and they done just fine.

    If i were a Lions supporter or one of their players i wouldnt want him on the team anymore. I mean look at all the loyal supporters over the years and the players being told they are a looseing culture by one of their own.They must make province pay through the nose and say toodleloo boet.

    I definetly think he will be off to province and unfortunetly province are going to voop next year with him and Habanna in the line. 😥

    Well Province lost JdV and gain JF so not much difference there. Of course JF plays 13 and JdV 12. They lost a great player in JdV but will gain with JF but now if JdV was there they would for sure be gaining something really special for those two to have played with each other.

    Habs they will get the best 11 in the country. That is a huge lose to Bulls.

    But on a different note, they young guy that bit the wp arm, i am thinking that is not something you do lightly and maybe he had a good reason like the guy was smothering his mouth and nose and he couldnt breath so it was a reflex reaction.

    How much influence do you think union decisions has on a player’s future?

    Mossie signed a contract on a date when there were certain structures and plans in place, he obviously based his decision on this as his future depends largely on the success of the union.

    Subsequent the Lions administration have done one dodge thing after the other like firing Loffie (under whom Jaque signed) and replace him with a high school coach just to name one?

    Jaque is not the only disgruntled Lions player – unfortunately for him, he is high profile.

    Contracts and agreements are based on deliverables, and frankly, the Lions admin has not delivered shit in the last couple of years.

    I for one can understand the disillusion players are going through going as far as even threatening to strike because of underhand dealings and decisions by the union.

    It might be the case, BUT he signed the contract and took the money. He knew what he was signing, and he accepted the pay, he had NO problem with that. I do believe Kevin and Manie will sort out the contract issue very soon.

    Fourie has forgotten the meaning of that 1 word “LOYALTY”. Alberts and the rest, they still have great respect for THAT word.

    In the issue with Bismarck on the cover. So unless someone can quote De Klerk or any other Lions official saying something different I believe it is a pathetic excuse.

    And also, WP’s involvement in this is simple.

    They are looking for a center, Jaque is looking for a new province.

    The issues here are between Jaque and his current union.
