Jaque Fourie does not have a standard players contract with the Golden Lions Rugby Union (GLRU) and that is just one of the reasons he believes his agreement with the union is not binding. He is also believed to be tired of having to play above himself to carry the Lions along with a handful of team-mates, and is said to be tired of the losing culture of the union. Fourie wants to leave the Lions to join Western Province, so that he can play for the Stormers next year.

Arbitration in the dispute between Fourie and the GLRU ended in Johannesburg on Tuesday, but a finding is only expected early next week. Information at Sport24’s disposal suggests that Fourie has a strong case.

The collective agreement between the South African Rugby Players’ Association (Sarpa) and the South African Rugby Employers Organisation (Sareo) determines that rugby unions must enter into agreements with players on standard players contracts.

Sports24 revealed the following:

-Fourie does not have a standard players contract with the union. He did, however, enter into an agreement with them on August 11, 2008.

– Sareo already on June 26, 2008 sent the standard players contract and new collective agreement to rugby unions, and there was no reason for the GLRU to not apply it to Fourie.

– The agreement that Fourie reached with the GLRU does not stipulate his remuneration for the second year of the so-called contract. Furthermore, the terms of his remuneration such as allowances, deductions, match fees and bonuses have not been filled in.

 – Fourie’s contract with the GLRU indicates that he has been appointed as a “professional analyst” and not a rugby player.

The Springbok centre believes his relationship with the GLRU has broken down because he was prevented from joining French club Clermont earlier this year and his salary for next season was not revised.

Fourie apparently followed grievance procedures, but talks with Lions chief executive Manie Reyneke and union consultant Jake White did not solve the problems.

He is tired of the losing culture at the union, which is preventing him from reaching his professional, personal and financial goals.

Sarpa chief executive Piet Heymans called on rugby unions and player agents to use the standard players contract.

“All the parties have to do on the standard players contract is to fill in the remuneration and the term. The rest is determined by a broad process of negotiations between Sarpa and Sareo. The provinces should take cognisance of the collective agreement, of which the standard contract is an attachment,” said Heymans.

 Sport24 has learned that six Lions players do not have standard contracts. Willem Alberts and Louis Ludik are also among them. Both have offers from the Sharks.

    anyway like i stated earlier, anyone leaving the lions now imo are making a mistake….they are going to lose out on something special with the resurgance of the union. and i dont support the lions but after watching them play their last few games was impressed with what i saw….and surprised.

    Any Agreement (Except a Last Will and Testament) creates a reciprocal situation, with rights AND obligations for the Parties attached to it.

    In not concluding proper Agreements with players, the GLRU MUST TAKE some of the blame. Not complying with SARPA’s Standard Agreement qualifications, must also be blamed mostly on the GLRU.

    In this instance, Jaque’s Contract is misleading and vague… some portions not even completed and Jaque described as an analist, not a player.

    So, certainly Jaque has some grounds to contest the validity of the Agreement and the Terms of the Agreement.

    That said, there is the general obligation on both Parties to show good will towards one another.. and that’s where I question Jaque’s motives.

    Without having personally seen Jaque’s Contract, I will not venture into giving you guys my idea of contract interpretation in this case and my legal opinion on the matter.

    I’m not a great Mossie fan – as someone remarked recently “sy balverspreiding herinner my annie Leeuloop”, and yes he appears too big for his boots from time to time, but surely he cannot be solely to blame for this breakdown in the relationship. Does it not take two sakkie-sakkie?

    Simply in terms of the contract (that’s if the facts above are complete and correct) what was the Lion’s legal advisor thinking when the offered him this…..well what is it – a players contract?

    No, ouens. I’m also hoping that the Lions get their act together and on the strength of the performances on the park of late it seems as if they are, but they might have to take their medicine on this Mossie issue.

    Let’s hope that Morne is wrong and that Alberts doesn’t do the Leeuloop as well.

    I have no problem with any player wanting to go and play else where, whether it is for money, lifestyle…BUT, if you have a contract, see out that contract, and when it is time for renewal, decline, say your moving on. Until then,. give your all to your union, like Bakkies did when he wanted to leave the Bulls.

    Wrt the Cape Town, I love it there, beautiful place, go there every year, prefer the Cape to Dbn.

    Amen on that. We might have not had the best of S14 the past few years, things might have been really down at the union, but I do believe things are happening and changing for the better, not just because I am a Lions supporter, I mean, even you have noticed.

    Ek sal ‘n opinie waag oor Jaque se kontrak: materiële terme moet op skrif wees. As sy betaling nie ingevul is nie is die kontrak te vaag.

    Daarom en oor al die ander beter redes, soos dat hy vir WP moet speel in die finaal, moet hy Kaap toe kom.

    The thing that I first thought of when I read this article is, how can you expect a guy to play a full, hard season of Super Rugby, when he publicly states that he is tired of the team and the union, cause he believes them to be losers.

    As a Stormers/WP supporter I wouldn’t say that, at the moment, we have the best winning culture. But I think at least as the Stormers, we have never done worse than the Lions (Lions, not cats). Plus, there are a few more Boks around in the WP camp. If JF leaves, thats that for the Lions.

    Anyway, whether he wants a “snob-lifestyle”, hanging out on blue flag beaches, or just wants to play for WP, let the poor man GO!

    So basically, GLRU said to themselves, “lets keep this guy and NOT pay him what he deserves”.

    Seriously, Mossie is one of the biggest guns in their team. Ok, imagine this, the Bulls tell Matfield and FdP, we can fill in the term of the contract now, 2 years (cause WE want that) and then we can just fill in the renumeration later (cause YOU want that). At the same time, we don’t have to pay you a players salary, cause you aren’t, technically, but when it suits us, we want you to be. Oh, and when you do ask us to sort out the money issue, we just won’t.
    Also, we don’t care if you could have made millions more overseas, or if you are the best and only international player we have left. We just don’t feel like paying you what you want. But you should play for us, thats what we want.

    Its clear whats going on. The GLRU are run by a bunch of fat cat, doesn’t give two sh*ts about rugby, gravy train, “Jozie-yuppie”, cock-heads, who should be in the SA gov.
    They sold the naming right to coke (cause who gives a F* about tradition in rugby), so they could pay of their debts, then they want to stick more money in their pocket, cause they accumulated more debt. And probably through Top Billing furnished sky boxes and prostitute parties.
    I feel sorry for the players and supporters of the union, past and present. You guys deserve better!
